Redwine and Sherrill has been in existence since 1958 and
throughout this period has helped its clients prepare and
administer wills and trusts.
Many people fail to develop their own estate plans and as a
result, it may be necessary to establish a probate in the court to
administer their estate and make certain the assets get to the
legal heirs. Sometimes litigation arises; the firm has represented
many clients in these matters.
Estate planning may sometimes include the use of trusts. The most
common of these is the revocable living trust that will help avoid
probate proceedings, which can be time-consuming and expensive.
These trusts can also include tax-saving provisions when
considering estate taxes.
Good estate planning also includes the use of Durable Powers of
Attorney for business and personal matters. The use of this
document provides for an agent who can take over for you when you
are no longer able to handle your own affairs.
The use of the Advance Health Care Directive is also important
when estate planning issues are being discussed. The use of this
document allows you to designate an agent to make health care
decisions when you are unable to make them yourself. The same
document also deals with end of life decisions, and organ and
tissue donation.
After proper estate planning, it may be necessary to administer
the terms and provisions of the trust. This includes providing
legal advice to the successor trustee and providing proper notice
to the beneficiaries. Eventually, assets will need to be
distributed and transferred to the beneficiaries; this may include
the preparation of trust transfer deeds, preliminary change of
ownership reports, and sometimes claims for exemption from
reassessment of real property taxes.
